EPA: No Fast-Tracking Data Centers!

Trump’s Environmental Protection Agency (EPA) wants to change the air permitting requirements to allow Big Tech to start construction on certain components of data centers before air quality permits are issued. We can’t let that happen.

Air quality permits are required to protect the air we breathe from polluting industries — whether it’s a pipeline or a data center. Now the EPA wants to rollback permitting rules to make it easier for companies to begin construction on polluting projects despite public opposition.

I oppose the EPA’s proposed rule, “Begin Actual Construction in the New Source Review (NSR) Preconstruction Permitting Program” (Docket ID No. EPA-HQ-OAR-2025-0618), which would allow companies to begin certain construction activities before obtaining NSR permits. Allowing work to begin before a permit is issued — even on “non-emitting” components — undermines the Clean Air Act’s purpose by creating pressure to approve permits after costly construction is underway. Letting construction begin risks making it harder to deny permits or require strong pollution controls.

This proposed rule would increase the risk of additional emissions and long-term harm. The NSR program exists to ensure projects do not worsen or degrade local air quality, which it accomplishes through preconstruction permitting. The EPA’s claim that applicants accept the “economic risk” if permits are ultimately denied fails to address the risk to communities of polluting projects proceeding when they shouldn’t, resulting in irreversible environmental and health impacts and further contributing to the disproportionate pollution burdens that frontline communities face.

For the sake of public health, environmental justice, and the integrity of the Clean Air Act, EPA should withdraw this proposal and maintain the current preconstruction permitting requirements.

I urge you to prioritize the health, safety, and welfare of our communities over the profits of Big Tech and Big Oil by immediately rescinding this proposed rule.
